On November 7, the Japan Fair Trade Commission launched a special website for the "Act on the Control of Trade and the Promotion of Trade" which will come into effect on January 1, 2026.
<Traditional Business Tales - Subcontracting Law>
The previous "Subcontracting Act and Subcontracting Promotion Act" have been amended. The Subcontracting Act is now called the Act on the Proper Operation of Small and Medium-Sized Enterprises in Contracting Transactions, and the principal contractor will become the contracting contractor. In addition, the Subcontracting Promotion Act is now called the Act on the Promotion of Contracting Small and Medium-Sized Enterprises, and the subcontractors will become small and medium-sized contracting contractors.
The special website provides video explanations of the revised points item by item. For the Act on the Regulation of Transactions, it explains the following: "Prohibition of unilateral price determination without consultation," "Prohibition of payment by promissory note, etc.," "Addition of employee criteria to the application criteria," "Addition of specific transportation consignment to the target transactions," and "Strengthening of area-wide enforcement."
Both examples compare the current law with the revised law, highlighting key points and explaining them clearly through animated comics.
The Promotion Act explains the following: "support for collaborative initiatives involving multiple levels of businesses," "establishment of new provisions defining the responsibilities of the national and local governments," "encouragement of strengthened authority by the competent minister," and "addition of applicable targets."
